Trump Calls For A Harsh Punishments For People Who Desecrate The American Flag
President-Elect Trump says that people who burn the American flag should lose their citizenship and possibly be jailed.
President-Elect Donald Trump Tweeted Tuesday morning about what the consequences should possibly be for burning an American flag:
Nobody should be allowed to burn the American flag – if they do, there must be consequences – perhaps loss of citizenship or year in jail!

If the flag burners were to lose their citizenship, they would presumably be deported under Trump’s proposed immigration plan.
In many countries, burning their flag is a criminal offense and can result in jail time. Just to name a few, you can be put in jail or face huge fines for burning that country’s flag in Argentina, the Philippines, Australia, Mexico, Germany, France, and Italy.
Donald Trump has always been one to speak his mind, but according to the Supreme Court, making laws against burning the American flag is unconstitutional. The US Supreme Court states that the right to burn or desecrate an American flag falls under our first amendment rights of freedom of speech. According to Texas vs. Johnson and U.S. vs. Eichman, the United States flag is a form of symbolic speech that falls under the first amendment.
Over the past several years, there have been more than a dozen attempts to make a constitutional amendment which criminalizes the burning of the American flag. So far, no attempts to make flag burning illegal have been successful.
