Constable Justin Johnston Has Life-Threatening Injuries

Dayton, TX – Liberty County Precinct 1 Constable Justin Johnston, was struck by a vehicle Wednesday afternoon, and remains in critical condition.

According to ABC 13 News,  the incident occurred about 5:15 PM at the intersection of FM 1413 and Highway 146 in Dayton.  Liberty County Precinct 1 Constable Johnston was directing traffic along with several other Deputies.  A truck was seen speeding down the shoulder of the road and through multiple barricades before it slammed into Constable Johnston and several patrol vehicles.

The driver of the vehicle, Samuel Leyva, also struck several patrol vehicles before hitting Constable Johnston, according to ABC 13.  The Texas Department of Public Safety said that Leyva’s eight-year-old daughter was a passenger in the truck.  Leyva was injured during the crash.

Leyva, his daughter, and Constable Johnston were all flown to Memorial Hermann Hospital for further treatment. Leyva is reported to have suffered a broken leg and is listed in serious condition.  His daughter had minor injuries. Her name has not been released.

Leyva’s blood was tested at the hospital to see if he was impaired but the results are not back yet.

Liberty County Sheriff’s Office Captain Ken DeFoor said that all law enforcement vehicles who were assisting with traffic control had all of their emergency lights on.  Captain DeFoor also said that Constable Johnston had severe head injuries.

Constable Justin Johnston remains in critical condition after emergency surgery for bleeding in his brain.  He has been placed into a medically-induced coma and remains in ICU.

No charges have yet been filed against Leyva, but the investigation is ongoing, and charges are expected.
