The Department of Justice made a court filing on Thursday before a federal appeals court which said that it is unconstitutional to hold poor people in jail when they can’t afford bail.

“Bail practices that incarcerate indigent individuals before trial solely because of their inability to pay for their release violate the Fourteenth Amendment,” the Department of Justice said in a friend of court brief.

The filing came in the case of Maurice Walker of Calhoun, Georgia. Walker was held for six days for a pedestrian under the influence charge when he was unable to pay the $160 bail.

“Fixed bail schedules that allow for the pretrial release of only those who can play, without accounting for the ability to pay,” the government said, “unlawfully discriminate based on indigence.”

The federal judge agreed with the filing in January, and ordered the city to release everybody arrested on misdemeanor offenses.

Unfortunately, the DOJ’s solution of releasing all people pre-sentencing has a glaring issue; releasing criminals without bail gives them free (literally) reign to commit crimes.

Despite DOJ’s nonsensical solution, it addresses a real problem. When people have their bail set for crimes, it does disproportionately affect poor people. If a poor person gets a bail set that they cannot afford, then they may need to spend more time in jail pre-conviction than they ever would have been sentenced to if they are convicted. If the person is acquitted, then they may have spent months in jail for a minor crime only to be found not-guilty. This process incentives poor people to plead guilty, because a guilty plea often results in less jail time.

This is a problem with no easy solution, but automatically releasing poor people is the wrong solution.

Bail is a system designed to release suspects from jail pre-conviction, while ensuring that they show up to court. By automatically releasing suspects, they have no incentive to show up to court to answer for their crimes. When the suspect doesn’t show up to court, they will get a warrant issued for their arrest, which also has bail attached to it. Assuming that a poor person is picked up on a warrant, they would presumably be released from jail again upon their arrival. In the end, it would effectively be impossible to sentence any poor person who didn’t want to show up to court.

Some people have suggested that if somebody fails to appear for court, then they should be denied bail on their subsequent warrant. This solution is also unrealistic. Jails are already overloaded, and denying bail to anybody who fails to appear to court would quickly pack the jails. If the jails are full, then the warrants can’t be enforced, because there’s nowhere to book the criminals.

      When at the end of my career as a patrol officer (before advancing) even a warrant under 500 bucks or sometimes more, the person was just cited or told to go to court (sure they did, NOT). When the jail was full, you couldn’t book someone unless it was a serious felony.

    A damn good example is that which is listed in this article. A man stopped for public intoxication is held long past the point where he is intoxicated because of the inability to pay a high (to him) bail. So long after the point where the person who was arrested should be sober and is no longer “a threat” to teetotalers everywhere he is held. Likely losing any chance at employment. Many of these “crimes” should not be jailable offenses, and if they are they should not require bail.

    Its mostly a problem at state court. Federal courts already have a release program if they can find someone to vouch for them. County courts make some serious coin in their draconian policies. Our own county jail makes millions in jail fees. Then if you skip and are re-arrested, its like the county hits on three cherries. Even if you make bail you can still get hit with thousands in fees. Holy handgrenade of Antioch its staggering the fees. I’m going to randomly pull up some file and just list a few lines of fees. I did it once but put on the whole redacted file and it was 30 pages long. Its insane.

    So someone held under bail of, for instance, $250,000 for assault with a firearm with intention to kill, can’t afford their bail, they’ll be released? Oh my!!

      I believe they are referring to infractions and misdemeanors, not felonies. When I worked in a jail, 40 years ago, we would release anyone (if they didn’t have warrants and they had no record of failure to appear) on a misdemeanor charge. Felony charges had to go through an OR (own recognizance ) clerk, employed by the courts, to get released without bond. Most who were arrested for just being under the influence (alcohol), were released after they sobered up,many with no charges filed.

I realize that this particular issue of being able to post bail is intended to show that the “poor” are probably involved in a higher number of crimes resulting in incarceration and that the bail system “discriminates” against them (the poor). My concern is, where will the judicial system draw the line as to what crimes will dictate who is released on their own recognizance? Will a system like this result in a higher crime rate? As you know, the repeat offenders could have a field day knowing they’ll be back on the streets even if they can’t/don’t have to post reasonable bail.

    People are not locked up pretrial because they can’t afford bail. They are locked up because there is probable cause that they committed a crime. Also, the indigence of a defendant is irrelevant to whether they can afford to pay for a bond as the defendant rarely if ever bonds himself out. The bail bond is typically secured by the family. So even if the poorest defendant in the world is being held in jail pretrial, he can bail out if his family is willing to vouch for him and put up the money. There are many issues in the criminal justice system that are broken, but bail is not one of them. Releasing a defendant on a financially secured commercial bond is one of the most effective ways to ensure their appearance in court….every legitimate 3rd party study ever done has shown this. The DOJ and the federal government should focus on keeping people out of jail in the first place (rebuilding the family unit and improving education) as opposed to just using letting them out of jail for free as a solution.

      You are correct. Bail is an insurance policy usually 10% of the bail amount plus fees charged by the bondsman, to guarantee you will show up in court. The bond amount is set dependent on the charge and usually is the same for all who commit the same offense. That being said, what is considered excessive means different things to different folks. If you are found guilty when you appear in court, most courts will deduct the days you have stayed in jail from your sentence and some will get out with time served. I can see bailing out a person who has a job if the court date is set out for months. The issue here is there should be consequences for all who commit the same crime regardless. Anything less is discrimination. If you plan on using a public defender, you should not bail out because the judge will figure if you can afford bail, you can afford an attorney. A novel idea is don’t do the crime if you can’t do the time.

    The issue is not bail and the ability to pay it. The issue is committing a crime that requires either bail or incarceration while awaiting trial. The concept is based on the belief you are more likely to show up for trial if it costs you something not to. If you have nothing to lose (bail), then release makes NO sense! Might as well do away with pretrial bail all together if you’re not going to apply the law equally.

    I must have missed the part of the Constitution that said, “Laws will apply to everyone except the very rich, well connected politicians and the very poor.”

    Ok, I get it, if we let poor people out when they can’t afford bail that will remove the incentive to show up to court. That’s definitely a problem. I however fail to understand the last point that denying bail to people who fail to appear will fill our jails up . They effectively are denied bail now since they can’t afford. Letting people who can’t afford bail out of jail while waiting for their trial will lower the number of people in jail. Even if all of them skip their trial and end up in jail without bail then you simply have the same number of people in jail as you did before.

    Kentucky has a great way to handle this. Its called “Bail Credit”. Essentially, bail credits means that you get credit towards your bail for every day you are in jail, starting with day 1. You get 100 bucks off each day. So, if you get a DUI, then you might see a 500 dollar bail, and be offered bail credit. The day you are booked in your bail is 400 because it starts crediting on day 1, the next day 300, the following day 200, the following day 100, and then the next day you can get out without needing to put any money up. This ensures that people who are not able to post bail are still able to get out without spending an unnecessary amount of time in jail, but that you are not simply released immediately because you are “poor”.

    Your eligibility for bail credit is also determined by things such as criminal history, risk of flight, etc. So, if someone is drunk and gets a dui and gets out on bail credit 5 days later, but then does not show up for court, and gets arrested on a failure to appear, then they won’t be eligible for bail credit.

    There are also other things done, such as weekenders, work release, etc.

    So, we can’t release poor people from jail pre-conviction because they may not show up to court, but we can’t put in jail people who already didn’t show up for court because the jails are too full? Wouldn’t releasing first-time misdemeanor offenders free up some room for people who have already shown themselves to not be relied upon to show up for court?

    Obama commuted thousands of non violent felon sentences anyway so why even bother arresting more law breakers? Just give them an appearance ticket a life coach and a check for $30,000. Throwing someone in jail, processing them through the system, a public defender, court fees, parole officers and everything else has to be well over $30,000. But $30,000 in the hands of an individual supervised by a life coach is enough to support oneself for at least 10-12 months and get oneself into a state vocational training program and moving in the right direction. If the individual still hasn’t made the effort to help his or herself (say half way through the first year under supervision) he or she will be issued a warning of an impending arrest and felony charge for fraudulent misuse of state and/or federal dollars at the end of the court supervised intervention. No more excuses and no sympathy. This is a chance to get it right. If the individual is not interested in getting it right then government is no longer interested in helping you either. Anyway you look at it, $30,000 is not a huge monetary investment by the government; particularly for a first time offender who still has the potential to become a productive member of society…It is either jail or jobs training which will get the individual off the government books altogether. Makes more sense and is certainly less expensive over all when it comes to jailing, releasing, probation, follow up and all the court fees; not to mention rate of recidivism.
    For those of you who are now angry over such a suggestion because you think it is not fair, I say get over it. Life is not fair and just because you and I do the right things most of the time doesn’t mean that we become monsters and refuse to look at the circumstances surrounding first time offender offenses. We need to find a solution to these issues and locking people up every single time is not always the solution. OK, let the hate mail fly.

    This ignores the traditional idea that adults need to take responsibility for their lives. That includes financial responsibility. It is a moral shortcoming to be so broke that you cannot bail yourself out of jail for minor offenses, offenses that you should have been responsible enough not to commit in the first place.

    I think jail should be rethought anyways… addressing more important crimes.. crimes that kill people. Crimes that physically harm people. In some cases also abusive mentally. Point being is we jail way more people compared to other countries and it costs lots of money. MOney that could address the social issues. which in turn creates aberrant behavior. Drug use or selling, stress related behavior.
